Exemptions from work permits that do not necessitate a certificate of exemption

Exemption from work permits refers to cases where foreign workers in Vietnam are exempted from the work permit issuance procedure, however, they must obtain a confirmation of exemption as prescribed by law. In practice, there are certain individuals, such as foreign direct investors, who, depending on their positions, occupations, and maximum permitted stay in Vietnam to perform their specialized work, are eligible for work permit exemption.
 

Some special cases are exempted from work permits without the need for a confirmation certificate

In the following cases, foreign workers are not required to undergo the procedure for confirmation of non-applicability for a work permit but must report to the labor management authority (Department of Labor/Ministry of Labor) in the locality where the foreign worker intends to work, providing the following information: full name, age, nationality, passport number, name of the foreign employer, start date and end date of work at least 3 working days prior to the expected start date of work in Vietnam.
  1. Foreigners entering Vietnam for less than 3 months to provide services
  2. Foreign lawyers licensed to practice law in Vietnam
  3. Foreign owners or limited liability company members with a direct capital contribution of VND 3 billion or more:
  4. Foreign chairmen or members of the board of directors of a joint stock company with a direct capital contribution of VND 3 billion or more
  5. Foreigners working in Vietnam as managers, directors, experts, or technical workers for less than 30 days and no more than 3 times in one year
  6. Family members of foreign diplomatic representatives in Vietnam
Therefore, if your foreign employees fall into the aforementioned categories, your company will not need to go through the procedures of obtaining a labor permit exemption certificate or follow processes such as job posting and reporting as required for cases with work permits. Your company only needs to report to the state management agency before the foreign employee starts working, in accordance with the regulations.
