Issuing a new work permit for the company's executive director
For enterprises that require the use of foreign labor as their executive directors and are conducting the procedures for the first time, this is referred to as a "new issuance" of a work permit. Typically, when applying for a new work permit, you must prepare the procedures according to the conditions for a new issuance.
In the case of issuing a new work permit for an executive director, it is necessary to understand what an executive director is, the regulations governing executive directors, and the job titles applicable to executive directors.
According to current legal documents, an executive director is a person who falls into one of the following categories:
- A person who heads a branch, representative office, or business location of an enterprise.
- A person who heads and directly manages at least one area of an agency, organization, or enterprise and is directly supervised and managed by the head of the agency, organization, or enterprise.
The company's CEO is a foreign national
The executive positions are specified in the company's bylaws or the operational regulations of an agency, organization, or enterprise. The business registration certificate, certificate of incorporation, or other equivalent legal documents;

- Health certificate: A health certificate or medical examination certificate issued by a competent health authority in a foreign country or Vietnam, valid for a period of 12 months from the date of issuance until the date of submission, or a certificate confirming good health as prescribed by the Minister of Health.
- Police clearance certificate: A police clearance certificate or a document certifying that the foreign worker is not currently serving a sentence, has not had a criminal record expunged, or is not currently subject to criminal prosecution, issued by a foreign or Vietnamese authority. The police clearance certificate or document must be issued within six months of the application submission date.
- Personal documents: Passport, visa, and a 4x6 cm color passport photo with a white background.
The executive director must also provide information on their education, previous management experience, and expertise relevant to the managerial position in a Vietnamese company.

To renew a work permit for an executive director, the following steps must be followed:
- Job posting: In accordance with the law, the foreign national must post the job in the province/city where they will be working. The location is determined based on the business registration certificate. Typically, the job posting is done through the provincial/city's job center for a period of 15 days.
- Request for approval to use foreign labor: This step, also known as explaining the need for foreign labor, involves requesting approval for the specific position. The processing time is usually 15-20 days.
- Work permit issuance: A work permit is issued based on the complete application and the approved job position.
Please note when submitting a work permit renewal application for a CEO: All documents must be original or certified copies. If the documents are from a foreign country, they must be legalized and translated into Vietnamese and notarized or authenticated in accordance with Vietnamese law.
