Issuing a new work permit for the company's manager

For enterprises requiring the use of foreign labor, the initial procedure for employing a foreign worker at the enterprise is called a new work permit issuance. Typically, when applying for a new work permit, you must prepare the necessary documents according to the requirements for new issuance.
 
In the case of issuing a new work permit for the company's manager, we need to understand what a manager is, the regulations governing managers, and the job titles applicable to managers.
 
According to current legal documents, a manager is defined as an individual who manages a business as stipulated in Clause 24, Article 4 of the Enterprise Law, or is the head or deputy head of an agency or organization. Specifically, a business manager is an individual who manages a private enterprise or a company, including the owner of a private enterprise, a general partner, the Chairman of the Board of Members, a member of the Board of Members, the Chairman of the Company, the Chairman of the Board of Directors, a member of the Board of Directors, the Director or General Director, and individuals holding other managerial positions as stipulated in the company's charter.
 
Therefore, based on the enterprise registration certificate, business registration certificate, and investment certificate (for foreign-invested enterprises), the manager of the enterprise can be identified. In cases where the manager's name is not on the business registration certificate, the company's charter, which stipulates these positions, shall be the basis.
 
The company's manager is a foreign national
 
We utilize the company's documents to apply for a new work permit for the company's manager. The required documents for the manager to proceed with the work permit application process include:
  1. Company bylaws or operational regulations.
  2. Business registration certificate, certificate of incorporation, or equivalent legal documents.
  3. Resolution or appointment decision appointing the manager.
Personal documents of the manager:
  1. Health certificate issued by a competent health authority in the foreign country or Vietnam, valid within 12 months.
  2. Police clearance certificate or a document certifying that the foreign worker is not currently serving a sentence, has not had a criminal record expunged, or is not currently subject to criminal prosecution, issued within 6 months.
  3. Passport, visa, and a 4x6 cm color passport photo with a white background.
In addition, the manager must provide information about their education, previous management experience, and qualifications that meet the company's specific management requirements in Vietnam.

To apply for Vietnam work permit for company’s manager, the following procedures must be followed:
  1. Job posting: In accordance with the law, the foreign manager must apply for a job posting in the province/city where they will be working. The specific job center to submit the application is determined based on the business registration certificate. The posting period is typically 15 days.
  2. Approval for foreign worker usage: This step involves explaining the need to hire a foreign worker for the specific position. The processing time for this step is usually 15-20 days.
  3. Work permit application: This step involves submitting an application for a work permit based on the approved position and documentation.
Please note that when submitting a work permit renewal application for a foreign executives, all required documents must be original or certified copies. If the documents are issued by a foreign authority, they must be legalized unless they are exempt from legalization under international treaties to which Vietnam and the foreign country are both parties, or under the principle of reciprocity, or as otherwise provided by law. Documents in a foreign language must be translated into Vietnamese and notarized or authenticated in accordance with Vietnamese law.
