Reissuance of work permit for foreign workers in Vietnam

In the course of working in Vietnam, if your work permit is lost, damaged, or if the information on your current work permit needs to be changed (due to negligence or force majeure), you must go through the procedure to re-issue a work permit for foreigners. It is advisable to re-issue your work permit as soon as possible after the loss or change. The procedure for re-issuing a work permit is quite simple and convenient.
 
Specific cases requiring the re-issuance of a work permit are as follows:
  1. If your valid work permit is lost, you must immediately report it to the local police (ward/commune police), the company's headquarters if the loss is suspected at the company's headquarters, or the place where the incident occurred. Remember to request a confirmation of the report from the police (ward/commune).
  2. If your valid work permit is damaged, you must keep the original work permit and write a statement with the company representative's confirmation regarding the damage.
  3. If any of the following information is changed: full name, nationality, passport number, place of work, or company name without changing the business registration code on the valid work permit.
  • For changes in the foreign worker's name, nationality, or passport number: Please prepare a new passport to complete the re-issuance procedure. 
  • For changes in the workplace: If the company relocates within the same province/city, please provide the amended business registration. If the company relocates to a different province/city, please reapply for a work permit at the new location. 
  • For changes in the company name without changing the tax code: You must reapply for a labor use approval before proceeding with the work permit re-issuance procedure.
 
A new work permit should be issued promptly following any changes or loss
 
Required Documents for Re-issuance of Work Permit:
  1. A written request for re-issuance of work permit from the employer as per Form No. 11/PLI, Appendix I.
  2. Two color photographs (4 cm x 6 cm in size, white background, frontal view, bare-headed, no tinted glasses), taken within the past 6 months.
  3. The valid work permit previously issued: 
    a) If the work permit is lost, a confirmation from the local police authority where the foreign worker resides or a competent authority of the foreign country as prescribed by law is required. 
    b) If there are changes in the information on the work permit, supporting documents are required.
Within 03 working days from the date of receipt of a complete application for re-issuance of work permit, the Ministry of Labor, Invalids and Social Affairs or the Department of Labor, Invalids and Social Affairs shall re-issue the work permit. In case of refusal to re-issue the work permit, a written reply shall be provided stating the reasons.
