Typically, the process of obtaining a work permit for a foreign worker involves the following basic steps:
 

I. Preparation and Completion of Procedures Before Applying for a Work Permit

  1. The company must post job vacancies as required by law;
  2. After the recruitment process is complete, the company must submit an application for approval to employ foreign workers in the registered positions;
  3. All required documents must be prepared in accordance with current regulations and must contain complete and accurate information.

II. Document Verification Procedures for Foreign Personnel:

1. In addition to basic information about the company's documents, such as licenses for establishment and operation in accordance with current business law,

2. Foreign personnel must also provide documents to prove their work in accordance with their specific positions:

  • For company managers and directors: 
    - Company charter and operating regulations
    - Appointment as director
  • For experts: 
    - Relevant professional qualifications
    - At least 3 years of experience in a relevant position as certified by a foreign organization or institution.
  • For technical workers: 
    - Technical training certificate
    - At least 5 years of experience in a relevant position as certified by a foreign organization or institution.
  • Additionally, depending on the specific job, personnel may need to prepare other relevant documents to demonstrate their professional competence, as long as it is consistent with the job requirements and the company's needs.

3. Other documents required from foreign personnel: 

  • A health certificate with a validity period of no more than 12 months from the date of submission;
  • A valid temporary residence permit;
  • A photocopy of the household registration book and 4x6 cm white background photo.
Note: Foreign documents must be consularly legalized (unless exempted).
Once all the documents for companies established in a specific province/city have been prepared, you can submit them at the relevant local authority (whether it's your head office, branch, or store). You can easily complete the procedures following the prescribed process.

The processing time for a permit application is 45-50 working days, but this can be extended if the application is incomplete. (For example, if there are missing documents, errors in the application, or incorrect arrangement of documents, you may need to wait an additional 15-20 working days to receive a result.)
3. Higher Incidental Costs 
When applying for a work permit for foreigners, you need to prepare costs for filing the application, translation, travel, printing, etc. Moreover, you may have to re-pay all of the above costs if there are errors in the application.
