Article 6. Sanctioning procedures for concurrent acts are prescribed in the Penal Code

When detecting violations specified in Point d Clause 1, Point c Clause 2, Point b Clause 3, Points b and c Clause 4, Points a and d Clause 5 Article 7; Points b and c, Clause 4, Article 9; Point a Clause 3, Points a and b Clause 4 Article 10; Point c Clause 2, Clause 5 Article 11; Point c Clause 3, Points b, dd and e Clause 5 Article 12; Point e Clause 3, Points a and b Clause 4 Article 13; Points a, b, c and dd Clause 1, Points c, d and e Clause 2 Article 15; Point a, Clause 3, Article 16; Point a Clause 4, Point c Clause 6 and Point a Clause 7 Article 18; Point dd Clause 2, Clause 4 Article 19; Clause 3, Article 21; Clause 2, Clause 3, Points b, c, d, dd and e Clause 5 Article 23; Point c Clause 4 Article 26; Clause 2, Points b and d Clause 4, Points a and d Clause 5 Article 28; Clause 4, Article 32; Point c Clause 5 Article 34; Point a, Clause 2, Article 50; Point a, Clause 4, Article 51; Clause 1, Article 52 and Clause 1, Article 53 of this Decree, the competent person handling the case must transfer the violation file to the agency competent to conduct criminal proceedings for criminal prosecution according to the law. prescribed in Clauses 1, 2 and 4, Article 62 of the Law on Handling of Administrative Violations.

Article 18. Violations of regulations on exit, entry, transit, residence and travel

1. Warning or fine from 300,000 VND to 500,000 VND for foreigners traveling on Vietnamese territory without carrying passports, travel documents, international travel documents, or issuance documents. for foreigners entering, exiting, and residing in Vietnam or ABTC card.

2. Fine from 500,000 VND to 2,000,000 VND for one of the following acts:

a) Failure to notify competent authorities about the loss or damage of passports, laissez-passers, or valuable international travel documents; Documents issued to foreigners entering, exiting, and residing in Vietnam or ABTC cards;

b) Declare untruths to obtain, extend, restore validity or report loss of passport or travel document; Making false statements to obtain valid international travel documents; Documents issued to foreigners entering, exiting, and residing in Vietnam or ABTC cards;

c) Foreigners entering government areas requiring a permit without a permit or traveling beyond the permitted scope and time limit;

d) Failure to present passports, laissez-passers, documents valid for international travel, documents issued to foreigners entering, exiting, or residing in Vietnam or ABTC cards when competent agencies or persons Vietnam's right to request; Failure to comply with the requirements of competent Vietnamese agencies and persons on searching people, means of transport, objects, places of hiding evidence, and means of administrative violations;

d) Foreigners use temporary residence certificates, temporary residence extensions, temporary residence cards, and do not renew permanent residence cards in Vietnam for a period of less than 16 days without permission from a competent authority.

3. Fine from 3,000,000 VND to 5,000,000 VND for one of the following acts:

a) Crossing national borders without completing exit and entry procedures as prescribed by law;

b) Destroying, erasing, erasing, modifying or falsifying the form and content of passports, laissez-passers, and valuable international travel documents; Documents issued to foreigners entering, exiting, and residing in Vietnam or ABTC cards;

c) Donating, giving, renting, leasing, pledging, receiving pledges of passports, laissez-passers, and valuable international travel documents; Documents issued to foreigners entering, exiting, and residing in Vietnam or ABTC cards;

d) Allowing others to use passports, laissez-passers, or documents with international travel value; Documents issued to foreigners entering, exiting, and residing in Vietnam or ABTC cards to commit acts contrary to the law;

d) Use of passports, laissez-passers, and valid international travel documents; Documents issued to foreigners entering, exiting, or residing in Vietnam, or ABTC cards of other people for entry, exit, transit, residence, or to commit other illegal acts;

e) Foreigners use temporary residence certificates, temporary residence extensions, temporary residence cards, and do not change permanent residence cards in Vietnam
g) Foreigners who have been issued a permanent residence card but change their address but do not declare to re-issue; Foreigners entering border gate economic zones and coastal economic zones under visa exemption to go to other locations in Vietnam without a Vietnamese visa according to the provisions of law;

h) Tourist accommodation establishments that are hotels do not connect to the internet or computer network with the immigration management agency of the province or centrally run city to transmit temporary residence declaration information of foreigners. outside;

i) Accommodation facilities for foreigners to stay overnight but do not declare temporary residence or do not update temporary residence declaration information according to regulations; Foreigners do not provide or provide false information to accommodation establishments to declare temporary residence according to the provisions of law.

4. Fine from 5,000,000 VND to 10,000,000 VND for one of the following acts:

a) Using fake passports, fake travel documents, or valuable international travel documents; fake documents issued to foreigners entering, leaving, or residing in Vietnam or fake ABTC cards;

b) Foreigners use temporary residence certificates, temporary residence extensions, temporary residence cards, or non-replacement of permanent residence cards in Vietnam for more than 30 days to less than 60 days without permission from the competent authority. .

5. Fine from 10,000,000 VND to 15,000,000 VND for one of the following acts:

a) Foreigners enter, practice or engage in other activities in Vietnam without permission from competent Vietnamese authorities;

b) Foreigners use temporary residence certificates, temporary residence extensions, temporary residence cards, and do not issue permanent residence cards for more than 60 days to less than 90 days without permission from a competent authority;

c) Buying and selling passports, laissez-passers, and valuable international travel documents; Documents issued to foreigners entering, exiting, and residing in Vietnam or ABTC cards.

6. Fine from 15,000,000 VND to 20,000,000 VND for one of the following acts:

a) Carry out procedures for inviting and sponsoring foreigners to enter, exit, or reside in Vietnam but do not fulfill their responsibilities according to the provisions of law or declare untruthfully when carrying out invitation and sponsorship procedures. Guarantee for foreigners entering, leaving, and residing in Vietnam;

b) Foreigners entering the country for purposes or programs that have requested a visa, temporary residence card or extension of temporary residence;

c) Forging documents and records to obtain passports, travel documents, and valuable international travel documents; Documents issued to foreigners entering, exiting, and residing in Vietnam or ABTC cards;

d) Foreigners use temporary residence certificates, temporary residence extensions, temporary residence cards, and do not renew permanent residence cards for more than 90 days or more without permission from a competent authority;

d) Agencies and organizations that employ foreigners to work or work but do not carry out procedures for inviting or guaranteeing the issuance of visas or temporary residence cards, except in cases where the purpose is changed according to the provisions of law. .

7. Fine from 30,000,000 VND to 40,000,000 VND for one of the following acts:

a) Counterfeit passports, travel documents, and valuable international travel documents; Documents issued to foreigners entering, exiting, and residing in Vietnam or ABTC cards;

b) Entering or staying at an embassy, consulate, diplomatic representative agency, consular office or headquarters of an international agency or organization located in Vietnam without permission of that agency or organization ;

c) Foreigners residing in areas where foreigners are prohibited from residing;

d) Vehicle owners, vehicle managers, drivers of vehicles transporting people entering or exiting Vietnam illegally;

d) Organizing, brokering, assisting, instigating, harboring, concealing, creating conditions for others to leave, stay abroad, enter, stay in Vietnam or cross national borders illegally .

e) Foreigners who do not comply with the competent authority's decision to force them to leave Vietnam and continue to reside in Vietnam.

8. Additional penalties:

a) Confiscate evidence and means of administrative violations for acts specified in Points b, c, d, Clause 3; Point a Clause 4; Point a Clause 5; Point c Clause 6; Points a and d, Clause 7 of this Article;

b) Expel foreigners who commit administrative violations specified in Clauses 1, 2, 3, 4, 5, 6 and 7 of this Article.

9. Remedial measures:

Forced to return illegal profits obtained from violations specified in Point c, Clause 3 and Points a and c, Clause 5 of this Article.
